
HOUSE CONCURRENT RESOLUTION NO. 79

Requesting the West Virginia Courthouse Facilities Authority to
prepare a final report on the needs of the court facilities
throughout West Virginia in relation to spatial needs to
accommodate the various judicial offices and functions, to
compliance with the Americans with Disabilities Act (ADA), to
security needs and to other aspects which affect the overall
effectiveness and operations of the judicial system.
Whereas, In the legislative session of the year two thousand
one the West Virginia Legislature by statute created the West
Virginia Courthouse Facilities Authority to begin operating on the
first day of July of the year two thousand one; and
Whereas, The Authority was directed to complete a study on the
needs of the court facilities throughout West Virginia in relation
to spatial needs to accommodate the various judicial offices and
functions, to compliance with the Americans with Disabilities Act
(ADA), to security needs and to other aspects which affect the
overall effectiveness and operations of the judicial system; and
Whereas, The Authority was directed to present a report to the
Joint Committee on Government and Finance and that said report was to contain information as to the results of said study and to
provide recommendations to address the identified needs of
courthouse facilities and that the report was to be presented on
the first day of January of the year two thousand two; and
Whereas, The report presented on the first day of January of
the year two thousand two was preliminary in nature and did not
contain the entire set of information required by the Legislature
to address the needs of courthouse facilities throughout the State;
therefore, be it
Resolved by the Legislature of West Virginia:
That the West Virginia Courthouse Facilities Authority is
hereby requested to complete the study on the needs of the court
facilities throughout West Virginia in relation to spatial needs to
accommodate the various judicial offices and functions, to
compliance with the Americans with Disabilities Act (ADA), to
security needs and to other aspects which affect the overall
effectiveness and operations of the judicial system; and, be it
Further Resolved, That the West Virginia Courthouse Facilities
Authority shall present a final report on or before the first day
of January of the year two thousand three to the Joint Committee,
and that the report shall contain the complete findings of the
study together with recommendations to the Legislature on actions
that may be taken to address the needs of Courthouse Facilities throughout the State of West Virginia.
